Terms of Service for à la carte Florals
FEES AND CONTRACT
EVENT DATE AND LOCATION: Delivery will take place at the date and time agreed upon via email. Delivery location will be at the place agreed upon via email.
CANCELLATION: If the client cancels 60 days or more before the event date, the client may receive a partial refund. Blue House Florals will keep any money already spent preparing for the event including but not limited to: pre-purchased flowers, hardgoods, labor, and admin feeds. If the client cancels 59 days or less before the event, the client will not receive a refund.
RESCHEDULING: If the client would like to reschedule the event, the client must reschedule 60 days or more before the event. The client must choose a new event date subject to Blue House Florals’ approval that is within 365 days of the previously scheduled event date. If the newly chosen date is more than 365 days from the original date, Blue House Florals reserves the right to cancel the contract without further obligation and to keep any money that has already been spent preparing for the event including but not limited to flowers, hardgoods, labor, and admin.
FORCE MAJEURE: A “force majeure event” means any event that is beyond the control of the parties, such as a hurricane or other natural disaster or pandemic or other public health emergency. If a force majeure event causes the delay of or inability to perform the obligations under this contract, Blue House Florals will make every reasonable effort to reschedule the event with the client. If the client chooses to reschedule, within 30 days of the original event date and subject to Blue House Florals’ approval, the client must choose a new date that is not later than 365 days from the original event date. In the event of rescheduling, the client will be responsible for the cost of any additional goods required as a result of rescheduling. Such additional goods will be billed to the client at cost. If the client chooses to cancel, rather than reschedule, the client shall not be excused of its obligation to make all payments due under the contract as of the time of the force majeure event and shall not receive a refund for any payments made. If the client chooses to cancel, or does not reschedule according to the terms in this paragraph, Blue House Florals will be relieved of any further obligations under this contract.
CHANGES TO ORIGINAL FLORAL QUOTE The client can make changes to the order up to three (3) times. Beyond that, Blue House Florals reserves the right to charge an hourly rate of $85 for future changes. No changes can be made 45 days or less before the event. If the client asks for more work or more flowers, Blue House Florals has the right to increase the price. If, at any time, market prices of flowers change, Blue House Florals has the right to change the price of such flowers accordingly. Blue House Florals will provide notification to the client if such a price change occurs and will give the client the opportunity to choose alternative flowers. If the client requests a change to a design that requires more labor, Blue House Florals has the right to change the price and will first notify the client of such change.
FLORIST STYLE AND DISCRETION: The client is hiring Blue House Florals as an artist, and it is therefore at Blue House Floral’s discretion to create the design. If a particular color or flower is not available, Blue House Florals will make the best effort to honor the vibe and aesthetics of the event. Blue House Florals does not require permission in order to replace or alter designs as needed based on availability of florals. While every effort will be made to align with the vibe and aesthetic of the event, Blue House Florals cannot guarantee any particular color or particular flower.
HIERARCHY OF FLORALS: While Blue House Florals makes every effort to grow all of the flowers and foliage used for the event, nature cannot be predicted. Therefore, if needed, the following hierarchy will be used to supplement with flowers and foliage. In order of most desired to least desired:
other local farms within 100 miles (most desired);
USA flower farms shipped floral wholesaler (will prioritize USA grown); and
Floral wholesaler internationally grown (least desired).
VASES AND ADDITIONAL ITEMS: All non-flower items (e.g. vases, candle holders) that are part of the floral designs belong to belong to the client. The client is responsible for all flowers and items at the end of the event.
SUSTAINABILITY PLEDGE: Being a zero waste florist means Blue House Florals designs so that 90% or more of the items used can be composted, recycled, or reused.
DELIVERY AND SET UP: Delivery is not included in the à la carte floral pricing. Delivery will be billed separately based on distance and the amount of flowers. Set up is not offered for à la carte florals and the client is responsible for coordinating set up.
BREAKDOWN: Breakdown is not included in à la carte florals. It is the client’s responsibility to coordinate breakdown.
SOCIAL MEDIA AND WEBSITE: The client gives permission for Blue House Florals to use photographs from the event on Blue House Floral’s social media, website, or other marketing materials. Blue House Florals has the right to request images from photographer(s) and/or videographer(s) hired for the event.
MODEL RELEASE: Blue House Florals has permission to use the client’s image on Blue House Floral’s social media, website, and marketing materials.
INCLEMENT WEATHER: It is up to Blue House Floral’s discretion how the flowers will be designed. Blue House Florals is not liable for florals not holding up in inclement weather.
SAFE WORKING CONDITIONS: Blue House Florals has the right to terminate if it deems the event is not safe. In this event, Blue House Florals will be relieved of any further obligations under this contract while the client will still be responsible for the full contract price and will not be entitled to any refund.
